The Equality and Human Rights Commission has published the long-awaited final version of the technical guidance on sexual harassment at work, which includes comments made in the consultation on the draft. Among other matters, the guidance, coming into force on 26 October 2024, now makes clear that an employer will not be able to show they have taken the required steps to prevent sexual harassment unless they have undertaken a risk assessment.
